10 Medical Device Crimes that Led to Jail Time—Desai

In July 2015, Dipak Desai, former owner of the Endoscopy Center of Southern Nevada, was sentenced to 71 months in prison by federal prosecutors. The sentencing, reported in the Las Vegas Review-Journal, was in response to charges that Desai and center CEO Tonya Rushing defrauded private insurers, Medicare, and Medicaid. According to the U.S. Department of Justice release, the pair did this by billing for longer-than-actual anesthesia procedures between January 2005 and February 2008. 

Desai was a gastroenterologist who, with Rushing, pushed staff to overfill procedure schedules. According to Fox 5 Vegas, Desai was already serving a state sentence of life in prison, with potential for parole after 18 years, for his role in a hepatitis C outbreak that started at the center in 2007.  

Desai's sentence: 71 months in prison (to be served at the same time as prior state life sentence), $2.2 million in restitution, $2.2 million forfeiture
