The United States International Trade Commission initiated a patent investigation into a Chinese medical device manufacturer and two of its entities based in the United States. The patent investigation involves a series of medical systems used to treat sleep apnea, a condition that impacts a patient's ability to breath at night. On July 19th of this year, ResMed filed a complaint with the International Trade Commission. In the complaint, the company alleged that the Chinese medical device manufacturer was in violation of Section 337 patent violations. As part of its complaint, ResMed also requested both cease and desist and limited exclusion orders.For now, the investigation doesn't mean that the ITC has made a decision on the case. However, the governmental body will issue an investigation completion target date within the next six weeks. If the complaint is approved by the ITC, the panel may issue a ban on importation of these products. As of now, the United States has completed several Section 337, countervailing and antidumping investigations against products manufactured in China.
